This Trader / Creator Agreement (“Agreement”) is entered into between ChartsAndSetups.com (“ChartsAndSetups,” “Platform,” “we,” “us,” or “our”) and the individual or entity registering as a trading content creator (“Creator,” “you,” or “your”). When you post anything on our site, you become a "Creator" or a "Trader / Creator". For the purposes of our site a "trader / Creator" is the same as a "Creator".
This Agreement applies to Creators located in Canada, the United States, and the United Kingdom.
By registering as a Creator, posting content, or monetizing content on the Platform, you agree to be bound by this Agreement.

1. INDEPENDENT CREATOR STATUS
Creators are independent users of the Platform and are not employees, contractors, agents, partners, joint venturers, or representatives of ChartsAndSetups.com.
Nothing in this Agreement creates a fiduciary relationship, advisory relationship, employment relationship, or agency relationship between ChartsAndSetups.com and the Creator.

2. REGULATORY STATUS & NO INVESTMENT ADVICE
Creators acknowledge and agree that:
• ChartsAndSetups.com is not registered with the SEC, CFTC, CSA, FCA, or any other financial regulatory authority.
• Creators are not acting as registered investment advisors, portfolio managers, broker-dealers, or financial professionals unless explicitly disclosed and legally authorized.
• All content must be strictly educational and informational in nature.
Creators must not present content as:
• investment advice,
• trading signals,
• trade instructions,
• guaranteed results,
• or recommendations to buy, sell, or hold any financial instrument.

3. JURISDICTION-SPECIFIC COMPLIANCE
Creators are solely responsible for ensuring that their content complies with all applicable laws and regulations in their jurisdiction, including but not limited to:
• Canada: Provincial securities laws and CSA guidance
• United States: SEC, CFTC, and state securities regulations
• United Kingdom: FCA rules, including financial promotion restrictions
Creators agree not to hold themselves out as regulated financial professionals unless lawfully authorized.

4. CONTENT RESPONSIBILITY & ACCURACY
Creators are solely responsible for:
• The accuracy, completeness, and legality of their content
• All statements, claims, and representations
• Ensuring content is not misleading or deceptive
ChartsAndSetups.com does not verify, endorse, or guarantee Creator content.

5. REQUIRED RISK DISCLOSURES
Creators acknowledge and consent that:
• Platform-wide Trading & Investment Disclaimers will be displayed
• Creator-level disclaimers may be shown on their profile
• Post-level disclaimers may be displayed with individual posts
Creators may be required to provide custom risk disclosures or approve default disclaimers.

6. PROHIBITED CONTENT & CONDUCT
Creators must not post content that:
• Contains abusive, harassing, hateful, or threatening language
• Makes claims of guaranteed profits or risk-free trading
• Promotes scams, fraud, or deceptive practices
• Impersonates licensed or regulated professionals
• Violates intellectual property or privacy rights
• Encourages illegal activity
Violation may result in immediate suspension or permanent termination without compensation.

7. PLATFORM RIGHTS & MODERATION
ChartsAndSetups.com reserves the right, at its sole discretion, to:
• Review, moderate, edit, restrict, or remove content
• Suspend or terminate Creator accounts
• Withhold or reverse payments related to violations
All moderation decisions are final.

8. MONETIZATION & PAYMENTS
Creators may monetize content through subscriptions, tips, or other features offered by the Platform.
Creators acknowledge:
• Earnings are not guaranteed
• Payments are subject to Platform fees
• Third-party payment processor terms apply
• Taxes are the Creator’s responsibility

9. INTELLECTUAL PROPERTY LICENSE
Creators retain ownership of their content but grant ChartsAndSetups.com a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, distribute, and promote Creator content.

10. INDEMNIFICATION
Creators agree to indemnify and hold harmless ChartsAndSetups.com, its owners, officers, affiliates, and employees from any claims, losses, damages, liabilities, or expenses arising from:
• Creator content
• Creator conduct
• Regulatory violations
• Breach of this Agreement

11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, ChartsAndSetups.com shall not be liable for:
• Creator content or statements
• User reliance on Creator content
• Trading or investment losses
• Lost profits or consequential damages

12. TERMINATION
This Agreement may be terminated by ChartsAndSetups.com at any time, with or without notice.
Upon termination:
• Creator access will be revoked
• Content may be removed or retained at Platform discretion
• Outstanding payments will be handled per Platform policy

13. GOVERNING LAW & JURISDICTION
This Agreement shall be governed by the laws of the Province of Ontario, Canada.
Creators agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.

14. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings.
